Agreement to these terms

These Terms of Service govern your use of estateelevate.agency (the “Site”) and any services provided by Estate Elevate (“we”, “us”). By using the Site or engaging our services, you agree to these terms. If you engage us under a signed proposal, statement of work or service agreement, that agreement controls where it differs from these terms.

Our services

We provide marketing and media services for real estate professionals, including content batching, video editing, social media management, local SEO, Generative Engine Optimization (GEO), Google Business Profile management, AI lead-nurturing setup and website development. The scope, deliverables, timelines and fees for each engagement are set out in your proposal or service agreement.

Your responsibilities

• Provide accurate information, timely feedback and the materials and account access needed to deliver the work.
• Confirm that you own or have the rights to all content you give us, including footage, music, images, logos and listing information.
• Ensure that marketing we publish on your behalf complies with the real estate, advertising, fair housing and brokerage rules that apply to you.

Fees and payment

Fees, billing cycles and payment terms are those stated in your proposal or service agreement. Unless agreed otherwise, recurring services are billed in advance and work may pause if payment is overdue.

Intellectual property

Once paid in full, you own the final deliverables we create specifically for you. We keep ownership of our pre-existing materials, templates, workflows, scripts frameworks and know-how, and we grant you a licence to use them as part of the deliverables. Unless you ask us not to, we may show completed work in our portfolio.

No guarantee of results

Marketing outcomes depend on many factors outside our control, including your market, offer, budget and platform algorithms. Any results, statistics or return-on-investment figures shown on the Site, such as average ROI, describe past client outcomes and are not a promise or guarantee of future results.

Third-party platforms

Our work relies on third-party platforms such as Google, YouTube, Meta, WhatsApp and AI providers. We are not responsible for their availability, policy changes, account suspensions or ranking decisions.

Limitation of liability

To the maximum extent permitted by law, Estate Elevate is not liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Site or our services is limited to the fees you paid us for the services in the three months before the claim arose.

Use of the Site

The Site and its content are provided “as is” for general information. You may not misuse the Site, attempt to disrupt it, or copy its content for commercial purposes without our permission.

Termination and changes

Either party may end an engagement as described in the service agreement. We may update these terms from time to time; the effective date below shows when they were last revised. Continued use of the Site after changes means you accept the updated terms.

Governing law

These terms are governed by the law stated in your service agreement. Where no agreement applies, any dispute will first be addressed through good-faith discussion between the parties.
